Terms of Service

These Terms of Service ("Terms") govern your access to and use of the MindTrace learning platform (the "Service"), operated by MindTrace Education Private Limited ("MindTrace", "we", "us"). By creating an account or continuing to use the Service, you agree to these Terms.

1. The Service

MindTrace provides an evidence-based learning platform for standardised examinations and structured curricula, including practice, Verify Mastery sessions, mock exams, an Academic Twin, and personalised recommendations. Features may evolve over time.

2. Eligibility and accounts

You must be of legal age to enter into a contract, or have verifiable parental consent if you are a minor. You are responsible for keeping your credentials confidential and for activity under your account. You agree to provide accurate information and keep it up to date.

3. Acceptable use

You agree not to misuse the Service. In particular, you must not:

• Use the Service unlawfully, fraudulently, or to send spam.
• Infringe intellectual-property or privacy rights of any person.
• Attempt to interfere with the security or integrity of the Service (including malware, probing, scraping, or reverse engineering).
• Circumvent access controls, redistribute content, or use the Service to build a competing product.

4. Intellectual property

The Service, including its software, questions, explanations, Academic Twin outputs, and branding, is owned by MindTrace and its licensors. We grant you a limited, non-exclusive, non-transferable right to use the Service within your active plan for personal, non-commercial learning.

5. Payment, subscriptions, and refunds

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, taxes, cancellations, and refund mechanics are governed by the Paddle Buyer Terms and our Refund Policy.

6. Service availability

We work to keep the Service reliable but do not guarantee uninterrupted or error-free operation. We may perform maintenance, release updates, or modify features at any time.

7. Warranties and liability

To the fullest extent permitted by law, the Service is provided "as is" without implied warranties of merchantability, fitness for purpose, or non-infringement. Our aggregate liability arising out of or relating to the Service is capped at the fees you paid us in the six months preceding the claim. We are not liable for indirect, consequential, or special damages, including loss of profits, data, or goodwill. Nothing in these Terms excludes liability for fraud, death, or personal injury caused by our negligence, where such exclusion would be unlawful.

8. Suspension and termination

We may suspend or terminate access for material breach of these Terms, non-payment, security or fraud risk, or repeated or serious policy violations. On termination, your right to use the Service ends; educational data is handled per our Privacy Policy.

9. Indemnity

You will indemnify us against claims arising from your unlawful use of the Service, your content, or your breach of these Terms.

10. Governing law

These Terms are governed by the laws of India. The courts of Bengaluru, Karnataka have exclusive jurisdiction over disputes, subject to any mandatory consumer-protection law of your place of residence.

11. Changes

We may update these Terms from time to time. Material changes will be communicated in-product or by email. Continued use after changes take effect constitutes acceptance.
